TOUR CONFIRMATION AND/OR MOTORCYCLE RENTAL
With your signature on the Tour Confirmation & Rental agreement you accept these Terms and Conditions as a binding contract between Sol y Vida Viaggi travel agency, Harley Davidson Catania (in case of rental) and yourself, as the Guided Tour Participant. Please read them carefully.
The bike rental is a separate service offered and provided by Catania Harley Davidson which is a licensed rental company.
A separate contract for the rental service will be provided and a security deposit will be taken at pick-up (Authorization Only) and must be processed via valid credit card.
When booking a guided motorcycle tour with Sol Y Vida viaggi you accept and agree to the terms and conditions herewith.
DEPOSIT
A deposit will be taken for all tours to secure your place on the tour.
On receipt of your booking, a booking confirmation will be issued by email, confirming your place on the tour.
A 30% deposit is required at the time of booking for any reservation and booked 30 days before the pick-up date. The remaining balance must be paid in full within 10 days before the pick-up date.
At checkout, you give Sol Y vida Viaggi permission to charge your card(s) the 30% of the total costs as deposit 30 days before the pick-up date.
If Sol y Vida viaggi does not receive the remaining balance prior to 10 days before pick-up date, then Sol y Vida viaggi reserves the right to cancel the tour reservation and charge a cancellation fee.
RELEASE AND WAIVER
Every participant in a Motorcycle Tour is required to accept and sign a Tour Agreement and Liability Release Waiver before the Guided Tour begins. Sol Y Vida viaggi cannot accept a tour participant without these signed forms. Our agents can provide a copy of these forms.
CANCELLATION AND REFUNDS
A reservation may be cancelled up to 30 or more days prior to the pick-up date with no charge. 50% of the total booking will be applied towards cancellation fee if the booking is cancelled between 15 - 10 days from pickup time. 100% of the booking will be applied towards cancellation fee if the booking is cancelled within 1 week from pickup time or if the customer does not show up. Refunds, if applicable, will be issued in a form of store credit that can be redeemed within 1 year from the date it was issued.
TOUR CANCELLATION
In the rare event of a tour cancellation, Sol y Vida viaggi will notify all tour participants immediately.
In cases of cancellation from other travelers, if the tour doesn’t reach the minimum number of participants, Sol y Vida viaggi will either offer to operate the tour if all the booked customers agree to a supplemental charge. If customers do not accept to pay the supplement, Sol y Vida viaggi will refund their payment in full (except for the already activated insurance coverages), which will constitute the full settlement.
Sol y Vida viaggi is not liable for any additional costs or losses incurred by the tour participant due to Sol y Vida’s cancellation of tour due to lack of participation. This includes, but is not limited to the cost of pre-paid airline tickets, hotel reservations or car rentals to name few. Situations may arise which will make it necessary for us to cancel, advance or postpone a scheduled tour, change itineraries or make substitutions regarding hotels, cities, tour guides and other travel arrangements. In that event, we do not assume responsibility or liability for any resulting losses, expenses or inconvenience. Your full tour price will be refunded if the tour is cancelled prior to scheduled tour start date.
Sol y Vida viaggi includes adequate travel, health and accident insurance, as well as trip cancellation insurance.
NON-OBSERVANCE OF TRAFFIC LAWS AND GROUP TRAVEL REGULATIONS
If the tour participant does not comply with traffic laws or the requirements for group travel, Sol y Vida viaggi may cancel the contract and the rental motorcycle will be secured.
ALTERATIONS TO TOUR SCHEDULE
Tours operate on a seasonal basis and where seasonal variances and/or weather conditions cause changes in the tour routing and accommodations the itinerary will be adjusted accordingly, with alternate hotels, restaurants and roads being selected.
WEATHER CONDITIONS
Sol Y Vida viaggi strives to schedule its tours at a time of the year (March to October) when the weather in the touring area is typically pleasant for motorcycling. Many tours pass through areas where weather conditions can change very rapidly. Sol y VIda cannot be held liable for unpleasant or unsuitable weather conditions, and no refunds shall be granted for such conditions.
WAIVER COVERAGE
All Theft and Damage Waivers and Supplemental Liability Insurance options are subject to the express terms and conditions of the rental contract and do not include coverage for injury, personal property, or damage as the result of negligence such as illegal use or use of rental while under the influence of drugs or alcohol. A Police Report is required for all damages or accidents. All damages to rented motorcycle without a police report will be considered to be at the fault of the Renter.
INSURANCE
Sol y Vida viaggi includes adequate travel, health and accident insurance as well as Trip Cancellation Insurance. Motorcycles rental currently offers an optional kasko insurance, as well as Supplemental Liability Insurance.
FREE TRANSFERS
Transfer between airport and the contracted arrival and departure hotels and the motorcycles rental shop locations are included on all Guided Tours. All transfers are provided by private car/van.
HELMETS (INCLUDED)
Helmets and raincoats are provided with motorcycle rentals and tours.
However in this particular times clients are encouraged to bring their own helmets to ensure comfort and proper fit. You can also buy your new helmet in Harley Davidson Catania Store with a special price as guided tour participants.
LUGGAGES
A chase vehicle will hold and transfer your luggages from hotel to hotel during the tour days.
FUEL
Fuel costs are included on all Guided Tour riding days.
MOTORCYCLE RENTAL
The bike rental is an additional service offered, advertised and promoted by us as an intermediary, and autonomously provided by Catania Harley Davidson® which is a licensed rental company for which we are an external partner for the purposes of providing tours. Therefore this service will be governed by a separate contract between the traveler and Catania Harley Davidson® Rental Company directly.
It is the traveler’s responsibility to present a valid, appropriate driver’s license to hire a motorcycle. If that is not provided, the motorcycle will not be rented.
REQUIREMENTS FOR THE MOTORCYCLE RENTAL
- minimum age 21
- valid motorcycle license
- valid Id or passport
- valid credit card(s)
Minimum age 21:
By Italian law anyone under 21 can only ride motorcycles with less than 25kW (34hp).
Motorcycle license:
International compulsory is needed for non-EU license holders.
Security deposit by Credit Card on day of motorcycle pick-up:
Each motorcycle has a security deposit of 3.000 euros.
This amount will be held on your credit card, but not processed. Please ensure that you have enough funds to cover the damage deposit on your cards. No motorcycle will be allowed to leave the rental station if the security deposit is not covered by your credit card. In this event you will be still held liable for the rental payment charges in full. In most of the cases, the deposit is your maximum liability for theft or damage to the vehicle.
INSURANCE
All vehicles are requested by law in Italy to have third party liability insurance. So all rental vehicles will be covered against damages towards third parties and transported passengers.
Any limitation on damages on the motorcycle is made on the back of the rental company.
In case of total destruction or theft you will lose your entire damage deposit. In the event of damages to the bike, the damage deposit will be held on standby by the rental company and once damage has been assessed, you will informed and charged accordingly.
A kasko insurance can be subscribed as optional at the price of 30€ + VAT per day
VERY IMPORTANT:
•Damage to the rented motorcycle resulting from accidents between rental bikes are NOT covered by the third party liability insurance. In this instance the rental clients will be fully liable for any damage caused to people or motorcycles with no limitation.
•Damage to the rented motorcycle resulting from an accident where the rental client was under the influence of alcohol or drugs will also NOT benefit from the damage deposit limitation.
•Damage resulting from the rental client’s gross misconduct will also NOT benefit from the damage deposit limitation.
•In the event that your rented vehicle is confiscated by the police for circumstances depending from the rental client’s negligence, the rental client will be held liable for rental charges for the time the vehicle remains in police custody and for any additional charges related to this offence
MOTORCYCLE MODEL
We will always strive to supply the reserved motorcycle. However, in some instances this may not be possible and Motorcyclops tour experience will supply an alternative equivalent replacement motorcycle. In the unlikely event that this would not be possible Sol y Vida viaggi will provide a complete rental fee refund.
MOTORCYCLE BREAKAGE
All rented motorcycles are covered by breakdown assistance.
If a breakdown occurs you will immediately inform the relevant rental station and follow instructions until the problem has been solved. Failure to do so will result in a breach of contract and you will not be able to claim the rental refund for the loss of use of the motorcycle. In no circumstance, unless agreed with the rental station, you are entitled to abandon your rented motorcycle. Penalty for abandoning the rented bike without Sol y Vida viaggi consent will cost ….€.
PARTICIPANTS DUTIES
Riding a motorcycle can be dangerous. Sol y Vida viaggi cannot be held liable for any harm or injuries occurred during the use of rental motorcycles.
During the tour, participant’s responsibilities:
•to comply with passport and visa regulations;
•to comply with driving license requirements and traffic rules;
•to wear appropriate safety and protective attire at all times while operating a motorcycle;
•to operate said motorcycle on paved surfaces only and Participants specifically agree not to engage in off-road traveling, unless accompanied by and directed by a tour leader;
•to obey all ordinances, rules, regulations and laws;
•not to consume alcoholic beverages or any illegal substances prior to or during the motorcycle riding;
•to get along with other participants;
•to ensure you settle any hotel costs before you depart the hotel, for example; mini bar usage, food or drink bills, parking fees
•any damage to your hotel room must be reported immediately to your tour guide. You will be liable for the repair costs.
•if you don’t settle your hotel bill for additional services, food, laundry or drink etc, Sol y Vida will charge in addition to invoicing for the total cost.
•Customers are asked not to remove items from the room, this includes; towels, robes, pillow cases, pillows, blankets, electrical items etc. Any charges issued for loss of items from the room will passed onto the room occupants
PARTICIPANT IS LIABLE FOR:
•any consequence resulting from non-compliance;
•any traffic tickets received during the tour.
In any case of non-compliance, Sol y Vida viaggi reserves the right:
•to revoke the contract and remove the participant;
•to apply a service charge for all unpaid tickets.
In case a participant should leave the group during the tour trip for any reason, he will act at his own risk and will not be entitled to make any claim against Sol Y Vida Viaggi
OUR RESPONSIBILITIES
We accept responsibility for supplying as near as physically possible a tour package as described on our website tour booking pages, in our Tour Brochure or in our tour itinerary. We are unable to control any deficiencies in services due to local conditions, maintenance, industrial dispute, religion, politics, or weather. Occasionally routes will differ depending on weather or timing. In such instances, we will not be held liable for these changes as they would be done so in the best interests of the group as a whole.
We will ensure, as best we can, that the entire group remains together and arrives each day at our hotel. We are not and cannot be responsible for the actions of others in the group and as such, Sol y Vida viaggi will not be held responsible for; injury, accidents or death caused by another rider in the group. Similarly, Sol y Vida viaggi cannot and will not be held responsible for riders who become lost, which is why we highly recommend you ensure you have a means of arriving at the final destination each day.
TOUR CHANGES
Arrangements for your tour are made months, sometimes a year, in advance. It is therefore inevitable that changes can occur. In most cases, these changes will be minor and will not affect your holiday. However, in the event of a major change, we will advise you immediately and you may then (a) continue the tour with the new itinerary, (b) accept an alternative of the same or similar value, or (c) cancel your holiday with a full refund.
Minor changes such as slight route changes (using motorway instead of non motorway roads are often unavoidable due to time restraints or weather, in such cases we will not be held responsible for these changes as the decision is based upon the best interests of the group)
From time to time we may increase, or decrease the price of tours advertised on the website or marketing material and social media platforms. This may happen after you have made a booking and can occur for a number of reasons, such as; promotion, offers, increase in accommodation costs, currency rates, transport arrangements etc. We do not alter the price of bookings once you have made payment or adjust your booking fee to match a newly advertised rate, or the price has decreased due to the above examples.
IMAGE USE RIGHTS
Photos and videos produced by Sol y Vida viaggi are the property of Sol y Vida viaggi, which is also the owner of the copyrights. Sol y Vida Viaggi can use all such material for advertising and marketing purposes, including images in which participants can be recognized, without any charge from the participant. Participants who submit photos to Motorcyclops Tours website/social media etc agree to allow the use of such photos by Motorcyclops Tours for advertising and marketing purposes.
COMPETENT COURT
For any dispute the Catania Tribunal will be the sole competent court.
